CMA Merger Efficiencies Review – Call for Evidence
Response from Dr. Gönenç Gürkaynak, Esq.

Dr. Gönenç Gürkaynak, our founding partner and head of ELIG Gürkaynak’s competition law and regulatory team, has submitted his opinion in response to the UK Competition and Markets Authority’s (“CMA”) Call for Evidence on the Approach to Assessing Merger Efficiencies. The submission addresses, among others, the CMA’s analytical approach to rivalry-enhancing efficiencies, with a particular focus on dynamic and innovation-related efficiencies and the limitations of static and price-focused analytical tools in assessing them. The submission sets out detailed views on the CMA’s current practices and standards for assessing rivalry-enhancing efficiencies, particularly innovation-driven and dynamic efficiencies, and offers views to ensure that such efficiencies are evaluated in a forward-looking and context-sensitive manner throughout merger and acquisition review processes.
